California CA65 Test

 CA 65 Proposal
 In November 1986, the California government issued California Proposition 65 (CA 65), the full name of the Drinking Water Safety and Toxic Substances Enforcement Act of 1986. The regulation prohibits the release of hazardous substances specified in the proposal into drinking water, and consumers should be given clear and reasonable warnings if consumer products contain substances on the CA 65 Chemical Substances List.

 Proposal CA 65 requires the government to publish a list of chemical substances that contain carcinogens, birth defects or other reproductive toxicities, updated at least once a year. To date, nearly 1000 chemical substances have been included in the list, which is published by the California Office of Environmental Health Hazard Assessment (OEHHA). On March 19, 2021, OEHHA added molybdenum oxide and indium tin oxide to the CA65 list of hazardous substances due to their carcinogenicity.

 California’s 65 Hazardous Substances List does not set content limits, and only some substances have Safe Harbor levels. When individuals or groups question the safety levels of certain harmful chemicals in products, litigation can be filed. Regarding the control of harmful substances in products, CA65 refers to existing lawsuits or settlement agreements against such products to reach limit requirements and testing methods for certain substances in certain types of products.

 Although the CA 65 bill is a local government regulation in the United States, its influence cannot be underestimated because California’s economic level is leading among all states in the United States. There are the following suggestions for product manufacturers interested in the California market:
 A. Conducting full testing of products on the CA65 list does not meet the requirements of cost control. Therefore, supply chain surveys are an effective means to control product quality and cost;
 B. Pay attention to the products, materials and hazardous substances involved in litigation cases involving CA65, and focus on monitoring hazardous substances related to the company’s products and conducting full-process random inspection and control;
 C. If hazardous substances listed in the CA 65 list are inevitably present in the product, the product should be placed and posted with warning signs and warnings in the manner specified in CA 65.
